Terms of Use

Acceptance of Terms

By accessing or using the Address Income platform (the “Platform”), you agree to these Terms of Use (“Terms”). This is a binding agreement between you and Address Income, Inc (“Company,” “we,” or “us”). If you do not agree to these Terms, you must not use the Platform. By creating an account or using any features, you confirm that you are at least 18 years old and legally capable of entering into this agreement. We may update these Terms from time to time and will post the revised version on our website; continued use of the Platform after changes means you accept the updated Terms.

Accounts and Membership

User Accounts: To access certain features, you may need to create an account. You agree to provide accurate, current information during registration and to keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately at info@addressincome.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms or for security reasons.

Basic vs. Pro Membership: We offer different service levels:

  • Basic Members: Free access to general property listings and basic analytics.

  • Pro Members: Access to enhanced, “unlocked” investment analytics and tools. (Currently, Pro membership is offered at no charge as a promotional free upgrade.)
    Both Basic and Pro users are bound by these same Terms. We reserve the right to introduce fees or modify features of memberships in the future, with appropriate notice. If fees are introduced, you will have the opportunity to review and accept any new payment terms before being charged.

Permissible Use of the Platform

We grant you a limited, non-exclusive, non-transferable license to access and use our Platform and its content for your personal, non-commercial use in evaluating real estate and investment opportunities. This means you may view listings, use our investment calculators and analytics, and download or print reports for your own personal use. You must not remove or obscure any copyright, trademark, or other proprietary notices on content you obtain from our Platform.

All content and software on the Platform, including property listings, data, text, graphics, images, and our proprietary analytics (such as Address Income® metrics and investment calculations), are owned by us or our licensors and protected by intellectual property laws. For example, real estate listings data is provided through an MLS feed and is owned by the respective Multiple Listing Service; you acknowledge the MLS’s ownership and copyright in that data. We (and the MLS, as applicable) retain all rights to the content, and your use of it is subject to these Terms.

Prohibited Activities

When using our Platform, you agree NOT to:

  • Republish, redistribute, or resell any content or data from the Platform (including MLS listings or our analytics) for commercial purposes without our prior written permission.

  • Scrape, harvest, or use automated means (such as bots, scrapers, or spiders) to collect data or extract content from the Platform This includes refraining from data-mining the property listings or our analytical data.

  • Interfere with the Platform’s operation or security. Do not attempt to disable, overburden, or impair the Platform or its related systems (e.g., no introducing viruses, malware, or any harmful code).

  • Circumvent account or access controls. For example, do not share your Pro account with others, or try to access features you have not been granted.

  • Use the Platform for unlawful purposes or any purpose not intended by us. This includes no use of the information for any fraudulent activity, or in violation of any local, state, or federal law or regulation.

We reserve the right to monitor use of the Platform and to investigate and take action (including suspension or termination of accounts) against any misuse. Unauthorized use of the Platform may result in legal action, including under the Computer Fraud and Abuse Act and other applicable laws.

No Financial or Investment Advice

All information, tools, and analytics provided by Address Income are for informational purposes only. We do not provide financial, investment, or legal advice or recommendations. While our Platform offers real estate investment calculations and projections, these are not guarantees or predictions of actual results. Nothing on the Platform is intended to substitute for professional advice from a qualified financial planner, investment advisor, real estate broker (beyond our role as a brokerage for transactions), or attorney. You are solely responsible for any investment or financial decisions you make based on information from our Platform. Use your own judgment and consider consulting professional advisors before making significant real estate investment decisions.

Information Accuracy and MLS Disclaimers

We strive to provide accurate and up-to-date information on properties and market data. However, the real estate listings and other information on our Platform come from third-party sources (such as the MLS) and our own analytical models, and we cannot guarantee that all information is complete, current, or error-free. All listing information is deemed reliable but not guaranteed, and is subject to change or update without notice. For example, properties may be delisted or prices may change, and there may be errors or omissions in the data. We do not modify the original MLS listing data; we only overlay our analytics on top of it.

No representation is made regarding the accuracy of descriptions, measurements, or financial calculations. All measurements (e.g., square footage) and financial figures (e.g., rental income estimates, cash flow projections) are approximate and should be independently verified. You acknowledge that any reliance on the information obtained from our Platform is at your own risk. Always verify critical details independently (for instance, confirm property details with official sources or verify rental estimates with professionals).

Furthermore, you acknowledge that the MLS data presented is subject to the usage restrictions imposed by the MLS and is provided for your personal use in identifying properties for potential purchase or rental. You may not use MLS data obtained from the Platform for any commercial purpose outside of evaluating a personal real estate transaction. The MLS and we have made efforts to ensure the data’s accuracy, but neither we nor the MLS warrant or guarantee that the data is reliable or correct. 

Intellectual Property Rights

Our Content: The Platform and all content available through it (including our proprietary Address Income® analytics, website text, design, logos, graphics, software code, and arrangement of content) are owned by Address Income, LLC or licensed to us. All such content is protected by copyright, trademark, trade secret, and other intellectual property laws. Address Income® and our logos are trademarks of Address Income, LLC. You do not acquire any ownership rights in the Platform or content by using the service or by downloading permitted materials.

You may print or download PDF reports or information from the Platform for your personal use and information. However, you must not remove our branding or disclaimers from any materials you download. You also agree not to create any derivative works based on our content or reverse engineer any aspect of our Platform.

Third-Party Content: Some content on our site is provided by third parties, such as MLS property listings or links to external resources. Such content remains the property of its respective owners. For example, as noted, MLS listing information is owned by the respective MLS and is used on our site under license. All such third-party trademarks or copyrights displayed on the Platform are the property of their owners and are used for identification purposes only. Your use of that third-party content may be subject to additional terms imposed by the content provider.

If you believe any content on our Platform infringes your intellectual property rights, please contact us with details so we can investigate and respond appropriately.

Limitation of Liability

Use at Your Own Risk: The Platform and all information, content, and services provided are offered on an “as is” and “as available” basis without warranties of any kind. Address Income disclaims all warranties, express or implied, including but not limited to accuracy, reliability, title, merchantability, fitness for a particular purpose, or non-infringement.  We do not guarantee that the Platform will be error-free, uninterrupted, secure, or that any defects will be corrected.

No Liability for Certain Damages: To the maximum extent permitted by law, in no event will Address Income or its affiliates, or our and their respective officers, agents, employees, or partners, be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of (or inability to use) the Platform or any information on it. This includes, without limitation, any investment losses, lost profits, lost data, loss of goodwill, or the cost of obtaining substitute services, even if we have been advised of the possibility of such damages.

Liability Cap: To the extent we are found liable notwithstanding the above disclaimers, our aggregate liability to you for any and all claims arising from your use of the Platform is limited to $100 USD or the amount you have paid to us in the past 12 months for any paid services (if applicable), whichever is greater. Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Third-Party Services: If our Platform contains links to third-party websites or uses services not operated by us (for example, a link to a mortgage calculator from a third party, or a mapping service), those are provided for convenience. We do not control and are not responsible for third-party sites or services, and your use of them is at your own risk. We make no guarantees or warranties regarding any third-party content or services. You agree that we have no liability arising from your use of any third-party resources or websites linked from our Platform. 

Indemnification (Hold Harmless)

You agree to indemnify, defend, and hold harmless Address Income, LLC (and its officers, directors, employees, agents, and affiliates) from and against any and all claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) that arise out of or relate to:

  1. Your use of the Platform in violation of these Terms or any applicable law or regulation;

  2. Your breach of any provision of these Terms; or

  3. Any claim that your use of the Platform or content you derive from it (for example, a report you generate) violates any third-party rights or caused harm to a third party.

This means that if a third party sues us because of something you did wrong, you will be responsible for any costs or damages we incur. We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you will cooperate with us in asserting any available defenses).

Real Estate Brokerage Relationship

Use of the Platform does not by itself create a brokerage relationship or agency agreement between you and Address Income. While Address Income is a licensed real estate brokerage in Nevada (License #B.1002905) and our agents can assist you in real estate transactions, simply browsing listings or using our analytics tools does not mean we represent you as your real estate agent. An agency or client relationship with our brokerage is only formed when you enter into a formal agreement with an Address Income licensed agent for representation in a real estate transaction.

If you choose to inquire about a property or use our brokerage services, additional terms or agreements may apply (for example, a listing agreement if you are a seller, or a buyer’s brokerage agreement if you are a buyer). We fully support the Fair Housing Act and Equal Opportunity Act, and we do not discriminate based on any protected class or lawful source of income. 

Termination

We reserve the right to suspend or terminate your account or access to the Platform at any time for any reason, including violation of these Terms or inactivity. You may also cancel your account at any time by contacting us. Upon termination, your right to use the Platform will cease immediately. The provisions of these Terms that by their nature should survive termination (such as disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. By using the Platform, you agree that any disputes arising out of or relating to these Terms or the Platform that cannot be resolved informally will be brought exclusively in the state or federal courts located in Washoe County, Nevada, and you consent to the personal jurisdiction of those courts.

At this time, we do not mandate arbitration of disputes. However, we reserve the right to institute an arbitration policy in the future by updating these Terms, in compliance with applicable law. In any dispute between us, each party will bear its own attorneys’ fees and costs, except as provided under the Indemnification clause or if a law provides for shifting of fees.

Changes to These Terms

We may modify these Terms of Use from time to time. If we make material changes, we will notify users by posting the updated Terms on our website with a new effective date. It’s your responsibility to review these Terms periodically. Continued use of the Platform after an update signifies your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Platform and, if applicable, cancel your account.
